The rights enshrined in the bill of rights to the Constitution have been and will be subjected to constitutional litigation as South Africa continues to evolve as a democratic country. While advanced democracies such as the United States, Canada, France, Germany and Britain have the benefit today of years of constitutional reform, the South African context is somewhat different.

Media, in all its forms, plays a critical role in the evolution of the bill of rights in the Constitution and is not to be underestimated or marginalised. In the South African context, the rights enshrined in the bill of rights are not absolute and are therefore subject to limitation. Some may argue that this limitation may amount to censorship and is not in the public interest.
