Media law, in general, continues to be subjected to much scrutiny in the public interest. Most individuals to not appreciate the vast impact of censorship or the various disguises in which censorship manifests itself. The rights enshrined in the bill of rights to the Constitution have been and will be subjected to constitutional litigation as South Africa continues to evolve as a democratic country. While advanced democracies such as the United States, Canada, France, Germany and Britain have the benefit today of years of constitutional reform, the South African context is somewhat different.

Media, in all its forms, plays a critical role in the evolution of the bill of rights in the Constitution and is not to be underestimated or marginalised. Some may argue that this limitation may amount to censorship and is not in the public interest.
